Roundup Herbicide Lawsuit

Individuals filing Roundup lawsuits against Monsanto (now Bayer) allege that long-term exposure to the popular weed killer has caused cancer, including non-Hodgkin lymphoma. Plaintiffs claim Monsanto failed to warn the public about the cancer risks associated with glyphosate, Roundup’s active ingredient. Despite Monsanto agreeing to a nearly $11 billion settlement in 2020 to resolve most Roundup cancer claims, new lawsuits continue to emerge, with many people still seeking compensation for their injuries.

Timeline of Roundup Cancer Lawsuits

September 2024

  • A Missouri appeals court upheld a ruling in favor of Bayer. Plaintiff Stacey Moore’s appeal, based on his expert’s exclusion, was rejected as the expert was deemed unqualified to discuss Roundup’s link to cancer. Bayer has seen a series of wins recently and is pushing for Roundup litigation to reach the Supreme Court.

August 2024

  • The 3rd U.S. Circuit Court of Appeals in Philadelphia ruled in favor of Monsanto and Bayer, stating that federal pesticide law (FIFRA) preempts state laws requiring cancer warnings on Roundup labels. This ruling creates a split with other court decisions, and Bayer is aiming to bring the issue to the Supreme Court.

July 2024

  • A Philadelphia judge upheld Monsanto’s only trial win in that court, allowing EPA evidence that did not link Roundup to cancer while excluding evidence from the International Agency for Research on Cancer that did. This ruling could impact future cases as plaintiffs appeal. Bayer also lobbied Congress for protection from lawsuits, seeking to include language in a farm bill.

June 2024

  • A state court reduced a $2.25 billion verdict to $400 million for a Pennsylvania man. Bayer continued its push in Congress for a law limiting Roundup-related lawsuits.

May 2024

  • New lawsuits continued to be filed, including one from a New York plaintiff diagnosed with non-Hodgkin lymphoma in 2023 after using Roundup for 10 years.

April 2024

  • A Missouri court cut a $1.56 billion verdict to $611 million, citing a Supreme Court decision on punitive damages limits.

January 2024

  • A Pennsylvania man won a $2.25 billion verdict for his Roundup claim.

Have All Roundup Lawsuits Been Settled?

While Bayer offered $10.9 billion to settle over 100,000 claims, thousands of lawsuits remain open. People diagnosed with non-Hodgkin lymphoma after using Roundup may still qualify for future settlements or jury verdicts. Lawyers continue to accept claims.

Why Are People Filing Roundup Lawsuits?

People file lawsuits claiming Monsanto’s herbicide Roundup caused non-Hodgkin lymphoma or other cancers. Plaintiffs allege that Bayer and Monsanto failed to warn users about the cancer risk associated with glyphosate, the active ingredient in Roundup.

The “Monsanto Papers” – internal documents presented in court – suggest the company may have hidden the cancer risks for years. While Bayer maintains Roundup is safe, it stopped selling residential formulas in 2023. Commercial versions remain on the market.

Bayer argues that over 800 studies submitted to the EPA confirm Roundup’s safety, despite disagreements from agencies like the World Health Organization, which classifies glyphosate as a “probable human carcinogen.”

Am I Eligible To File a Roundup Cancer Lawsuit?

If you used Roundup regularly and later developed non-Hodgkin lymphoma, you may be eligible to file a lawsuit. Qualifications include:

  • Long-term exposure to Roundup or exposure at 12 years of age or younger
  • Diagnosis of non-Hodgkin lymphoma or related cancer after June 1, 2018
  • Roundup use at least two years before diagnosis
  • The statute of limitations in your state has not expired

Both individual lawsuits and class action claims have been filed seeking compensation for injuries and the cost of the product.
